Welcome to Con-Tak. By accessing or using our website (con-tak.com), web application (con-tak.app), or mobile app (collectively, the "Service"), you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree, do not use the Service.

1 Definitions

For the purposes of these Terms and Conditions:

  • "Company," "we," "us," or "our" refers to Tap-Tik LLC, a limited liability company registered in Texas, USA.
  • "Service" refers to Con-Tak, including the website at con-tak.com, the web application at con-tak.app, and any mobile applications.
  • "User," "you," or "your" refers to any individual or entity accessing or using the Service.
  • "Account" refers to the unique account created for you to access the Service.
  • "Content" refers to any information, text, images, data, or other materials you submit, upload, or display through the Service.
  • "Subscription" refers to a paid plan granting access to premium features of the Service.
  • "NFC Card" refers to the physical Near Field Communication card offered as part of certain Subscription plans.

2 Acceptance of Terms

By creating an Account, accessing, or using the Service in any way, you confirm that:

  • You are at least 18 years old or the age of majority in your jurisdiction.
  • You have the legal capacity to enter into a binding agreement.
  • You have read, understood, and agree to be bound by these Terms.
  • If using the Service on behalf of an organization, you have the authority to bind that organization to these Terms.

⚠️ Minors: The Service is not directed to individuals under 18. If you become aware that a minor has provided us with personal information, please contact us at contact@con-tak.com.

3 Account Registration

3.1 Creating an Account

To access most features of the Service, you must register for an Account. You agree to provide accurate, current, and complete information during registration and to update that information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You must notify us immediately at contact@con-tak.com if you suspect any unauthorized access to your Account.

3.3 One Account Per Person

Each individual may maintain only one active Account unless otherwise authorized in writing by Con-Tak. Businesses or teams wishing to manage multiple users should contact us for enterprise options.

3.4 Account Accuracy

You agree not to create an Account using false information, impersonate another person, or create an Account on behalf of someone else without their permission.

4 Description of Service

Con-Tak is a digital business card and sales enablement platform that includes, but is not limited to, the following features:

  • NFC and QR code sharing — Share your digital contact profile via tap or scan.
  • Personalized landing page — A custom URL displaying your professional profile.
  • Built-in CRM pipeline — A 4-stage lead management system (New → Prospecting → Quote → Closed).
  • Meeting scheduler — Integrated calendar booking functionality.
  • Real-time analytics — Insights on profile views, clicks, and saves.
  • Win/Loss intelligence — Deal outcome tracking with mandatory feedback notes.
  • Business card OCR scanner — Digitize physical business cards into your contact directory.
  • Inquiry widget — An embeddable contact form for your profile or website.

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with or without notice. We will make reasonable efforts to notify active Subscribers of material changes.

5 Use of the App

5.1 App Access

The Con-Tak application is accessible via web browser at con-tak.app and may be available as a mobile application. Access to the app requires a registered Account and, for premium features, an active Subscription.

5.2 Device Requirements

You are responsible for ensuring your device meets the minimum technical requirements to use the Service. NFC tap functionality requires a compatible NFC-enabled device. QR code sharing works on any smartphone camera.

5.3 Software Updates

We may release updates to the app from time to time. Some updates may be required to continue using the Service. We are not liable for any issues arising from your failure to install required updates.

5.4 Third-Party Integrations

The Service may integrate with third-party platforms such as Google Calendar, Apple Calendar, and social media networks. Your use of such integrations is also subject to the terms and privacy policies of those third parties. Con-Tak is not responsible for the practices of third-party services.

5.5 NFC Physical Card

Physical NFC cards offered as part of certain Subscription plans are subject to the following:

  • The card remains functional as long as your Subscription is active.
  • Con-Tak is not responsible for loss, theft, or physical damage to the card.
  • Shipping charges apply and are non-refundable.
  • Replacement cards may be purchased separately at the applicable rate.

6 Subscription & Billing

6.1 Plans

Con-Tak offers paid Subscription plans including Monthly and Annual options. Current pricing is available at con-tak.com/en/pricing.php. All prices are in US Dollars (USD) unless otherwise stated.

6.2 Free Trial

New users may access a free trial period of 15 days with full access to all features. No credit card is required to begin a free trial. At the end of the trial period, continued use of premium features requires a paid Subscription.

6.3 Billing & Renewal

Subscriptions are billed in advance on a monthly or annual basis. Your Subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize Con-Tak to charge your payment method on file for each renewal.

6.4 Founder's Rate

The Founder's Rate is a promotional pricing tier available to the first 2,000 Annual Subscribers. Users who qualify and maintain an active Annual Subscription will retain their locked rate for the duration of their continuous Subscription. The rate is non-transferable and forfeited upon cancellation.

6.5 Price Changes

We reserve the right to change Subscription prices. We will notify you at least 30 days in advance of any price change via email. Your continued use of the Service after the price change takes effect constitutes your acceptance of the new pricing.

6.6 Refunds

All payments are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 30 days at contact@con-tak.com.

6.7 Failed Payments

If a payment fails, we may suspend access to premium features until payment is resolved. We will notify you of the failed payment and provide a grace period to update your payment information.

6.8 Cancellation

You may cancel your Subscription at any time from your Account settings. Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the end of the paid period. Cancellation does not entitle you to a refund for any unused portion of your Subscription.

💡 Data After Cancellation: Your profile, contacts, and CRM data will remain accessible in read-only mode for 30 days after cancellation. After 30 days, your data may be permanently deleted. We recommend exporting your data before cancelling.

7 User-Generated Content

7.1 Your Content

You retain ownership of all Content you submit to the Service, including your profile information, contact details, photos, links, and notes. By submitting Content, you grant Con-Tak a non-exclusive, worldwide, royalty-free license to host, store, display, and process your Content solely for the purpose of operating and providing the Service.

7.2 Content Responsibility

You are solely responsible for all Content you submit. You represent and warrant that:

  • You own or have the necessary rights to all Content you submit.
  • Your Content does not infringe any third-party intellectual property rights.
  • Your Content does not violate any applicable laws or regulations.
  • Your Content is accurate and not misleading.

7.3 Prohibited Content

You may not submit Content that:

  • Is false, fraudulent, or impersonates another person or entity.
  • Is defamatory, obscene, pornographic, or otherwise offensive.
  • Promotes illegal activity or discrimination.
  • Contains malware, viruses, or other harmful code.
  • Violates any applicable law or regulation.

7.4 Content Removal

We reserve the right to remove any Content that violates these Terms or that we determine, at our sole discretion, to be harmful, offensive, or otherwise inappropriate. We will make reasonable efforts to notify you before removing Content.

8 Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation.
  • Engage in spam, unsolicited mass messaging, or any form of unauthorized advertising.
  • Harvest, scrape, or collect data from the Service without authorization.
  • Reverse engineer, decompile, or attempt to extract source code from the Service.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated bots, crawlers, or scripts to access the Service.
  • Resell or sublicense access to the Service without written authorization.
  • Use the Service for any purpose that competes directly with Con-Tak without written consent.
  • Circumvent any technical measures we use to enforce these Terms.

⚠️ Violation of this Acceptable Use Policy may result in immediate suspension or termination of your Account without refund.

9 Intellectual Property

9.1 Con-Tak IP

The Service, including its design, software, features, branding, logos, trademarks, and all underlying technology, is owned by or licensed to Tap-Tik LLC and is protected by copyright, trademark, and other intellectual property laws worldwide. These Terms do not grant you any rights to use Con-Tak's trademarks, logos, or brand elements without prior written consent.

9.2 Feedback

If you submit ideas, suggestions, or feedback about the Service, you grant Con-Tak an irrevocable, perpetual, royalty-free license to use that feedback for any purpose, including improving the Service, without obligation or compensation to you.

9.3 License to Use

Subject to these Terms and your compliance with them, Con-Tak grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

10 Privacy & Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and share your personal data when you use the Service. By using the Service, you agree to our Privacy Policy, which is incorporated into these Terms by reference.

10.1 Data Storage

Your data is stored on secure servers. We implement industry-standard security measures including SSL encryption in transit and encryption at rest.

10.2 Data Export

You may export your contact data and CRM information at any time from your Account settings. We recommend regular exports as a backup practice.

10.3 GDPR & International Users

If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with applicable data protection laws, you have specific rights regarding your personal data. Please refer to our Privacy Policy or contact us for more information on exercising those rights.

10.4 CCPA (California Users)

California residents have specific rights under the California Consumer Privacy Act. Please refer to our Privacy Policy for details.

11 Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Con-Tak does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate or reliable.
  • Any errors in the Service will be corrected.
  • NFC functionality will work on all devices.

Your use of the Service is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

12 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CON-TAK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL CON-TAK'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU PAID TO CON-TAK DURING THE 12-MONTH PERIOD IMMEDIATELY PRECEDING THE CLAIM.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.

13 Indemnification

You agree to indemnify, defend, and hold harmless Tap-Tik LLC and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your Content.
  • Your violation of any third-party rights, including intellectual property or privacy rights.
  • Any claim that your Content caused damage to a third party.

14 Termination

14.1 Termination by You

You may terminate your Account at any time by cancelling your Subscription and deleting your Account from the settings page. You remain responsible for all charges accrued prior to termination.

14.2 Termination by Con-Tak

We reserve the right to suspend or terminate your Account and access to the Service at our sole discretion, with or without notice, if we believe you have violated these Terms or for any other reason we deem necessary to protect the Service, other users, or third parties.

14.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law) shall survive.

15 Governing Law & Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve any dispute informally by contacting us at contact@con-tak.com. We will attempt to resolve the dispute within 30 days.

15.3 Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Hidalgo County, Texas, USA.

15.4 Class Action Waiver

You waive any right to participate in a class action lawsuit or class-wide arbitration against Con-Tak. All claims must be brought in your individual capacity.

15.5 International Users

Con-Tak operates from the United States. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. Nothing in these Terms restricts your rights under mandatory consumer protection laws of your country.

16 Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page with a new effective date.
  • Sending an email notification to your registered email address.
  • Displaying a notice in the Service upon your next login.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your Subscription.
